the answer is 3. once you un-check Enable Windows Server 2008 mode, you lose ABE. The only way to get it back is to recreate the namespace

I stand corrected. You must raise the functional level of the domain to 2008 prior to recreating the namespace. But you would still have to recreate the namespace

ABE requires Windows 2008 Server mode which can only be enabled during namespace creation.
